Burden Shifting

Why It Matters

Burden shifting solves a critical problem: how do you handle situations where direct proof is nearly impossible, but circumstantial indicators are strong? If you require complete proof from the start, defendants can simply stay silent and win by default. If you accept any allegation, defendants have no fair defense. Burden shifting creates a calibrated sequence: plaintiff must show enough to warrant explanation, defendant must provide that explanation, then plaintiff gets the last word to show the explanation is pretextual.

The Key Move

When facing a claim that's hard to prove directly, construct a minimal prima facie showing - enough circumstantial evidence that, if unrebutted, would prove your case. This forces your opponent to surface their explanation. Once they've committed to their explanation, you can focus all your energy on disproving that specific story rather than proving every possible alternative. Conversely, when defending, recognize that rebutting a prima facie case requires offering a legitimate explanation, not merely creating doubt - but your explanation only needs to be plausible, not proven.

Classic Application

Employment discrimination cases under McDonnell Douglas framework. Plaintiff proves:

  1. member of protected class,
  2. qualified for position,
  3. adverse employment action,
  4. position given to someone outside protected class. This doesn't prove discrimination, but it shifts burden to employer to articulate legitimate, non-discriminatory reason. If employer provides one (e.g., better credentials), burden shifts back to plaintiff to prove that reason is pretextual cover for discrimination. Each party has a specific, sequenced task.

Surprising Application

Relationship conflicts about unequal effort. Partner A claims Partner B isn't contributing fairly to household work. Direct measurement is impossible (different tasks, different values). But A can establish prima facie case: here are ten tasks I handle, what do you handle? This shifts burden to B to articulate their contributions. Once B lists theirs, conversation shifts to whether the lists are comparable - far more productive than the initial abstract "fairness" debate. The structure forces both parties to make concrete, rebuttable claims.

Failure Modes

Confusing shifted burden of production with burden of persuasion - even when burden shifts to defendant, plaintiff retains ultimate burden of persuading the decision-maker. Treating any evidence as prima facie sufficient - there's a minimum threshold that's context-dependent. Applying burden-shifting to contexts where direct evidence is actually available - it's a framework for indirect proof, not a substitute for better evidence you could obtain. Forgetting that rebuttal explanations must be specific and legitimate, not just possible.
